NE lottery was established on February 24, 1993, by LB 138, which was passed by the Nebraska Legislature.

In 2004, Nebraska voters passed an amendment formulating the distribution of the NE lottery funds. As per the formula, 44.5% of Nebraska lottery profits should go to Nebraska Education Improvement Fund. Another 44.5% of the NE lottery profit goes to Nebraska Environmental Trust Fund and 10% to Nebraska State Fair. The remaining 1% of the profits are for Compulsive Gamblers Assistance Fund.
